These damages of course include the immediate harm caused by a dog bite, such as treating puncture wounds or broken bones. Dog owners will also be liable for the treatment of subsequent conditions that develop as a result of the bite, such as infections or scarring.

If the dog injured the victim in some other manner, such as by tripping, New Jersey’s strict liability dog bite statute does not apply. Instead, the claim must proceed as a negligence case. In a negligence case, the injured victim must show:

  • The dog owner had a duty to prevent the dog from injuring others;
  • The dog owner breached this duty; and
  • Due to this breach, the victim suffered damages.

Each of these three elements must be proven for a victim to be successful in a negligence claim. If one of the elements is not present, the claim will fail and the victim will not be entitled to any damages from the dog owner.

There are a variety of damages available in a dog bite injury claim, depending on the nature of the incident. These may include lost wages, medical bills, pain and suffering, emotional distress, the cost of future medical care, and any other damages that are directly related to the injury. These damages are proven by submitting medical records and other documents.
