New Jersey takes dog bite claims very seriously. In fact, it has enacted statutes that impose strict liability on dog owners in cases involving dog bites. With strict liability, a dog owner is generally responsible for the damages that result from a dog bite claim. Whether the owner was actually negligent or not is not relevant in a strict liability claim. Therefore, it does not matter if the owner had installed a fancy new fence and had the dog on a leash when it bit the victim—the owner will still be liable for the harm the dog caused.

If a dog causes injuries in some other manner, however, the liability rules change a bit. If the dog injured the victim by jumping on the victim, charging at the victim, or in some other way that does not involve a bite, the strict liability laws do not apply. Rather, the victim must pursue a negligence claim against the dog owner. The victim must show:

  • The dog owner had a duty to prevent the dog from injuring others;
  • The dog owner breached that duty; and
  • The victim was injured due to this breach.

The victim must prove each of these elements to prevail in a negligence claim. If the victim cannot prove all three of these elements, the claim will fail and the victim will not be entitled to any damages. The victim will assume responsibility for all medical bills and other expenses associated with the injuries.
